Terms & Conditions of Service

Using this website

This website is owned and operated by Pawsitive Pooches. These Terms set forth the terms and conditions under which you may use our website and any services as offered by us. This website offers visitors information on our services and access to booking services. By accessing or using the website of our service, you approve that you have read, understood, and agree to be bound by these Terms.

By submitting any of the forms or making a booking through this website, the personal information given will be stored. This is done securely and your data will never be given or sold to any third party. We may use the information given to contact you and any email addresses will be added to our mailing list. You can be removed from the list at any time by contacting us or using the link in any of our promotional emails. For more information please read our Privacy Policy.

Making a booking or purchase

When booking a service or buying an item, you agree that:

(i) you are responsible for reading the full service or item listing before making a commitment to buy/book it

(ii) you enter into a legally binding contract to purchase when you commit to buy and you complete the payment process

(iii) you agree to read any instructions, requirements or pre-requisites for any of our services provided both at the time of booking and via confirmation of booking

(iv) you understand that you are responsible for ensuring you can attend booked sessions and refunds/replacements will not be provided for sessions not attended.

(v) any abuse of our booking system or policies and procedures will result in you being unable to request our services in future and may result in a ban from the system

 

Some services will offer an online payment option. When using third party services to make payment, the terms and conditions set forth by the third party service are your responsibility. Where an online payment option is not provided, BACS payment is our preferred payment method and the correct payment details will be provided either at the time of booking or in your booking confirmation. When choosing a service with BACS payment method, you agree to make payment within 48hrs of the booking/purchase or forfeit your booking. In the case of group session bookings with limited places, we reserve the right to offer to other clients those places where payment has not been received within 48hrs as these places are considered to be unconfirmed. The cost of your booking includes a £10 non refundable administration fee.

 

When completing any booking forms, you agree to ensure information provided is accurate and complete to the best of your ability. We reserve the right to reject bookings where the correct information is not provided or where important information is omitted.

 

The prices we charge for using our services / for our products may be listed on the website or provided as service quotes when you enquire with us. We reserve the right to change our prices for products displayed at any time, and to correct pricing errors that may inadvertently occur. Prices may also vary based on information you give us. Examples include but are not limited to: appointment time, location of appointment, or behavioural issues. Quotes given for behavioural services are valid for 14 days only. After this, any price increases that have occurred will be included in any new quotes.

If you are booking in more than one dog for any training type, an additional handler should be present. For group classes, each dog must be booked in separately and must have an individual handler. 

 

We may, without prior notice, change services; stop providing the services or any features of the services we offer; or create limits for the services. We may permanently or temporarily terminate or suspend access to the services without notice and liability for any reason, or for no reason.

Attending your booking

During all training sessions, you are fully responsible for the behaviour and safety of your dog and hold full liability for the dog and its actions. This includes, but is not limited to, indoor and outdoor group sessions, home visit appointments and outdoor one to ones. If your dog has known aggression issues, please ensure they are secured or muzzled before your trainer arrives. We reserve the right to forfeit your session if all appropriate precautions are not taken by you to ensure the safety of our trainer on your property.

For all bookings, a confirmation email will be sent. In the case of classes and courses, the location and what you need to bring will be included in the confirmation email, along with the date and time of the course. You are responsible for ensuring that you arrive on time and that you have brought the correct equipment to your session in order to ensure you can access all aspects of the training on offer. You will also receive reminders 3 days and 1 day before your booking. The trainer has the right to declare the session abandoned if you have not arrived within 15 minutes of your start time. Abandoned sessions will not be refunded. Late arrivals will be deducted from your purchased time. Persistent late arrivals may result in your service being terminated. 

For one to one sessions in-person, you will be informed of the location during the pre-booking discussion with your trainer. If you are unsure, please message us. Google Maps links can be provided if required. For home visits, you will be required to provide a full address at the time of booking. If your booking is online via Google Meet or Zoom or another similar service, you are responsible for making sure you are available at the time of the meeting. 

Please check your email/messages before travelling to any bookings to ensure there have not been any changes. We will endeavour to give as much notice as possible for cancellations or changes of location (usually these are only necessary for heavy weather, accident or sudden illness) and so we recommend you provide a mobile number when you book. 

During sessions, we reserve the right to take photographs and videos for use on our website and in our marketing. These will usually be focused on your dog, but if you object to your image being used, please inform us at the start of the class and we will not use any images or video footage featuring you. We will not identify you or share any personal information beyond your dog's name and their progress in our sessions. This also applies to photos submitted via booking forms.

Children may attend bookings with you but remain your responsibility at all times. Children under the age of 6 should have an additional responsible adult with them for safety reasons. In group sessions, children are not permitted to approach other clients and their dogs and should remain seated during the class. They are permitted to join in the training exercises only if supervised by you or another responsible adult.

Access to your trainer outside of your purchased sessions is limited to the trainer's working hours and at the trainer's discretion. Where you are invited to ask questions via email following your sessions, these should be about topics discussed in your sessions. Any additional information beyond what is covered in your sessions may require you to book or purchase additional services. We reserve the right to take all training access online in the event that sessions cannot be carried out face to face for any reason.

Cancellations and refunds

Refunds or replacements will not be given for any booking or appointment that you do not attend or where you change your mind and no long wish to continue, whether single sessions or part of a course. Cancellations will only be accepted if they are received before the cancellation deadline, currently set at 72hrs before the session start time. Any cancellations given within 72hrs of the session start time will be liable for full payment, except in the event that the booking can be resold. This is entirely at the discretion of Pawsitive Pooches. 

A £10 administration fee will be charged for cancelled bookings. This will be deducted from any refunds made.

 

Partial refunds will not be issued for sessions which are part of a course or package, or where a package or course has already commenced. At the discretion of the trainer, sessions booked as part of a private package may be rescheduled for a later date, or banked for later use, if sufficient notice of cancellation is given (minimum 72hrs). Sessions missed as part of a course cannot be refunded or replaced. You may transfer your booking to a friend or family member where appropriate and at our discretion for a small administration fee: please contact us to discuss. 

Unused sessions will expire if not booked within 1 year of purchase.

Promotional email and offers

You agree to receive from time to time promotional messages and materials from us, by mail, email or any other contact form you may provide us with (including your phone number for calls or text messages). If you don't want to receive such promotional materials or notices – please just notify us at any time.

Copyright

Where learning materials are provided as part of your booked service, you are not permitted to copy, share, transfer modify, sell, license, distribute, reproduce or publicly display them, or create any derivative works using them regardless of format.

 

The Service and all materials therein or transferred thereby, including, without limitation, software, images, text, graphics, logos, patents, trademarks, service marks, copyrights, photographs, audio, videos, music and all Intellectual Property Rights related thereto, are the exclusive property of Pawsitive Pooches, with some images used with permission from Les Toyne Photography. Except as explicitly provided herein, nothing in these Terms shall be deemed to create a license in or under any such Intellectual Property Rights, and you agree not to sell, license, rent, modify, distribute, copy, reproduce, transmit, publicly display, publicly perform, publish, adapt, edit or create derivative works thereof.

Right to modify Terms

We reserve the right to modify any and all terms from time to time at our sole discretion. Therefore, you should review these page periodically. Your continued use of the Website or our service after any such change constitutes your acceptance of the new Terms. If you do not agree to any of these terms or any future version of the Terms, do not use or access (or continue to access) the website or the service.

Indemnity and limitations of liability

You agree to indemnify and hold Pawsitive Pooches harmless from any demands, loss, liability, claims or expenses (including attorneys’ fees), made against them by any third party due to, or arising out of, or in connection with your use of the website or any of the services offered on the website.

 

To the maximum extent permitted by applicable law, in no event shall Pawsitive Pooches, be liable for any indirect, punitive, incidental, special, consequential or exemplary damages, including without limitation, damages for loss of profits, goodwill, use, data or other intangible losses, arising out of or relating to the use of, or inability to use, the service.

 

To the maximum extent permitted by applicable law, Pawsitive Pooches assumes no liability or responsibility for any (i) errors, mistakes, or inaccuracies of content; (ii) personal injury or property damage, of any nature whatsoever, resulting from your access to or use of our service; and (iii) any unauthorized access to or use of our secure servers and/or any and all personal information stored therein

All legal disputes will be goverened locally with the location determined by Pawsitive Pooches only.

For insurance purposes, the following are applicable to all clients who choose to use our services:

  • Breeds listed as 'banned' under the Dangerous Dogs Act 1991 will not be accepted for any appointment type

  • Breeds restricted to exemption status under the Dangerous Dogs Act 1991 will not be accepted in group classes but may attend one to one training sessions (outdoor or home visit) under the following conditions:

    • Exemption certificate, schedule of public liability insurance and proof of microchip/neuter status have been provided​ prior to your first appointment

    • Dogs with bite history are muzzled and on a lead for home visits

    • All exempted dogs are muzzled and on lead for outdoor one to one sessions

Failure to meet the conditions listed here may result in your appointment, and all future bookings, being terminated immediately. You will not be eligible for any refund if this occurs.​

Attempts to circumvent bans or restrictions on any breed by misrepresenting the breed of the dog in communications or booking forms will result in an immediate termination of all services without refund.

Complaints and Disputes

Should you have any disputes or complaints regarding services booked via Pawsitive Pooches, these must be taken up with your trainer in the first instance, after referring to these terms and conditions to ensure your complaint is not addressed here.  All disputes will be thoroughly investigated and a resolution reached wherever possible that fits within the scope of these terms. This resolution is at the discretion of Pawsitive Pooches and will be considered final. Final decisions on the outcome of the complaint remain with the business owners.

1.3 This site is intended for the use by citizens of the UK. This site in not intended for the distribution to, or use by, any persons in a country where such distribution or use would be contrary to local laws or regulations.

2.1 Throughout our website, trademarked names are indicated. However, rather that repeatedly show the trademark symbol, we state that we are using such names in an editorial contact with no intention of infringement of that trademark. Trademarked names, as always, remain the property of their respective companies.

3.1 We are continually seeking to update and improve the site. Therefore, we may make changes to any part of the site as well as these conditions and you will be bound by changes from the time you next access the site.

3.2 No purported modification of these conditions will be effective until we countersign it.

4.1 You must ensure that any software downloaded from the internet to your computer is suitable for use on your computer and that it is virus free. This applies to any software downloaded from this site so you must check all your software loaded from this site and ensure it is compatible with your computer.

We try to ensure, but do not guarantee or warrant, the accuracy or completeness, availability or reliability of the information on our website. Our aim is to keep this information timely and accurate. If errors are brought to our attention we will try and correct them.
